The company Wero Holding a.s., ID: 083 74 422, with registered office: Panská 890/7, Nové Město, 110 00 Prague 1, registered in the Commercial Register kept by the Municipal Court in Prague, Section B, Insert 25429 (hereinafter referred to as "Wero Holding a.s." or "Wero Holding a.s."), as the personal data controller, hereby takes the liberty to inform you, as the so-called data subjects, about the manner and scope of processing of personal data by Wero Holding a.s., including the scope of your rights related to the processing of your personal data by Wero Holding a.s.
1. What personal data does Wero Holding a.s. process about you?
Wero Holding a.s. processes, in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation; hereinafter referred to as the "Regulation"), and in accordance with the relevant national data protection legislation, the personal data you provide to Wero Holding a.s. in connection with the use of the Services. This personal data includes:
a. contact details
- e-mail
- telephone
Wero Holding a.s. processes this personal data only in accordance with the purposes set out below and to the extent and for the period necessary to fulfil these stated purposes.
2. For what purposes and on the basis of which legal titles does Wero Holding a.s. process your personal data?
a. Processing of personal data in connection with sending newsletters
In the event that Wero Holding a.s. receives your e-mail address, Wero Holding a.s. will process your personal data in the scope of - e-mail address, on the basis of your consent to the processing of personal data for the purpose of sending offer e-mails and other commercial communications by electronic means pursuant to Act No. 480/2004 Coll., on certain information society services. Wero Holding a.s. will start processing your personal data only after you have provided your e-mail address via the Wero Holding a.s. website or in business dealings with Wero Holding a.s. or a company linked to Wero Holding a.s. by property or personnel.
b. Processing on the basis of your consent
If you give your consent to Wero Holding a.s. to process your personal data, it will also process your personal data for the purposes stated in this consent.
3. For how long do we process your personal data?
If we process personal data for the purpose of sending newsletters on the basis of your subscription to them, these personal data are processed until you unsubscribe from receiving these newsletters via the link provided in the emails sent or otherwise withdraw your consent to receive the newsletters.
Personal data processed on the basis of a legitimate interest of Wero Holding a.s. is processed for a reasonable period of time during which our aforementioned legitimate interest lasts.
We use the professional and specialized services of other entities in the performance of our obligations and duties and the provision of our services. If these suppliers process the personal data we transfer to them, they have the status of data processors.
We only ever transfer your personal data to these processors to the extent necessary for the purposes of the processing and solely for the purpose of providing our services. We select only those persons as specific processors who provide us with maximum guarantees about the technical and organizational security of the protection of the personal data transmitted. We have concluded contracts with all processors and none of our processors is entitled to use the personal data provided for their own, marketing or any other purposes, except for persons and entities linked to Wero Holding a.s. by property or personnel. The processors are companies based both in the Czech Republic and in a member state of the European Union or in so-called safe countries. The transfer and processing of personal data in countries outside the European Union is always carried out in accordance with applicable legislation. Current list of our processors:
4. Data transfers outside the EU
In some cases, Wero Holding a.s. may also transfer your personal data to countries that are not part of the European Economic Area in connection with the use of the services of certain foreign companies (Google, Facebook). Wero Holding a.s. only ever transfers personal data to companies that are committed to strictly protecting your personal data, and only from the United States. Despite this, we must warn you that the US is a country that does not provide an adequate level of data protection; this implies, among other things, that government agencies in the US may be entitled to access your personal data without effective remedies.
5. What rights do you have in relation to the processing of personal data by Wero Holding a.s.?
You have certain rights in relation to the processing of your personal data by Wero Holding a.s.. These rights include:
a. Right of access - based on this right, you have the right to know what data is processed about you, for what purpose, for how long, where your personal data is collected, to whom it is transferred, who processes it outside of Wero Holding a.s. and what other rights you have in relation to the processing of your personal data. Although all information should be included in this information (or other documents referred to in this information), if you are unclear, you may contact Wero Holding a.s. for further information.
b. Right to rectification - in the event that you discover that the personal data processed by Wero Holding a.s. about you is inaccurate or incomplete, you have the right to have it corrected or completed without undue delay.
c. Right to erasure - in some cases you have the right to have your personal data erased. Your personal data will be deleted without undue delay if any of the following reasons are met:
- The personal data is no longer needed for the purposes for which it was processed,
- you withdraw your consent to the processing of your personal data, the data is data for which your consent is necessary and there is no other reason why the data can continue to be processed,
- you exercise your right to object to processing (see below under Right to object to processing) in respect of personal data which is processed on the basis of legitimate interests of Wero Holding a.s. and it is established that there are no longer any such legitimate interests which would justify such processing; or
- you consider that the processing of personal data carried out by Wero Holding a.s. is no longer in accordance with generally binding regulations. This right shall not apply if the processing of personal data is still necessary for the fulfilment of a legal obligation of Wero Holding a.s. or for the establishment, exercise or defence of legal claims.
d. Right to restriction of processing - in some cases, in addition to the right to erasure, you may exercise the right to restrict the processing of personal data. This right allows you in certain cases to request that your personal data be marked and not subject to any further processing operations - in this case, however, not forever (as in the case of the right to erasure), but for a limited period of time. Wero Holding a.s. will restrict the processing of personal data if:
- you contest the accuracy of the personal data before it is established what data is correct,
- your personal data is processed without a sufficient legal basis (e.g. beyond what can be processed), but you would prefer to restrict such data before erasing it (e.g. if you expect to provide such data to Wero Holding a.s. in the future anyway),
- your personal data is no longer needed for the above processing purposes but is required for the establishment, exercise or defence of legal claims; or
- you object to the processing. The right to object is described in more detail below under Right to object to processing. Wero Holding a.s. is obliged to restrict the processing of your personal data for the period of time during which it is investigated whether your objection is justified.
e. Right to portability - You have the right to obtain from Wero Holding a.s. all personal data that you have provided to it and that are processed on the basis of your consent. Your personal data will be provided to you in a structured, commonly used and machine-readable format. In order to make the data easily transferable at your request, it may only be data that is processed automatically in electronic databases.
f. Right to object to processing - You have the right to object to the processing of personal data that is based on a legitimate interest of Wero Holding a.s. Wero Holding a.s. will then cease processing the personal data unless there are compelling legitimate grounds for continuing such processing. Wero Holding a.s. will always stop processing your personal data for direct marketing purposes upon objection.
g. Right to lodge a complaint - you may at any time lodge a complaint in relation to the processing of your personal data with the supervisory authority, which is the Office for Personal Data Protection, Pplk. Sochora 27, 170 00 Prague 7, e-mail: posta@uoou.cz.
